GENERAL TERMS AND CONDITIONS OF THE ONLINE STORE shop.insidetrading.bg
I. SUBJECT

Art. 1. These general terms and conditions are intended to regulate the relations between "Inside Trading" EOOD, UIC 204655133, with registered office and address of management: Bulgaria, Sofia, hereinafter referred to as the SUPPLIER, and the customers, hereinafter referred to as the USER AND/OR CONSUMER, of the e-commerce platform shop.insidetrading.bg, hereinafter referred to as "shop.insidetrading.bg".

II. DATA ABOUT THE SUPPLIER

Art. 2. Information according to the Electronic Commerce Act and the Consumer Protection Act:

III. PLATFORM CHARACTERISTICS

Art. 3. shop.insidetrading.bg is an e-commerce platform, accessible at the Internet address http://www.shop.insidetrading.bg, through which Users have the opportunity to conclude contracts for the purchase and sale and delivery of the goods offered by the Provider on the platform, including the following:

1. To register and create a profile for browsing the Provider's e-shop and using additional services for providing information;

2. To review the goods, their characteristics, prices and delivery conditions;

3. To conclude with the Supplier contracts for the purchase and sale and delivery of the goods offered by the platform shop.insidetrading.bg;

4. To make any payments in connection with the concluded contracts, incl. by electronic means of payment.

5. To receive information about new goods offered by the Supplier on the platform shop.insidetrading.bg;

6. To make electronic statements in connection with the conclusion or execution of contracts with the Supplier on the platform shop.insidetrading.bg through the interface of the shop.insidetrading.bg page, accessible on the Internet;

7. To be notified of the rights arising from the law, primarily through the interface of the platform shop.insidetrading.bg on the Internet;

8. To exercise their right of withdrawal, where applicable, under the Consumer Protection Act.

Art. 4. The Supplier on the shop.insidetrading.bg platform organizes the delivery of the goods and guarantees the rights of the Users, provided for by law, within the framework of good faith, accepted in practice, consumer or commercial law criteria and conditions.

Art. 5. (1) The Users conclude with the Supplier on the shop.insidetrading.bg platform a contract for the purchase and sale of the goods, at the address http://www.shop.insidetrading.bg. The contract is concluded in Bulgarian and is stored in the Supplier's database on the platform.

(2) By virtue of the contract for the purchase and sale of goods concluded with the Users, the Supplier on the shop.insidetrading.bg platform undertakes to organize the delivery and transfer of ownership to the User of the goods specified by him through the interface on the platform. Users have the right to correct errors in entering information no later than sending the statement for concluding the contract to the Supplier on the shop.insidetrading.bg platform.

(3) Users pay the Supplier on the shop.insidetrading.bg platform a fee for the delivered goods in accordance with the terms and conditions set out in the shop.insidetrading.bg platform and these general terms and conditions. The fee is in the amount of the price announced on the shop.insidetrading.bg platform. In the event of a technical error in the price, the Supplier shall immediately notify the User of the correct price of the product and shall have the right to refuse an order placed due to an incorrect indication of its real price.

(4) To place an order for some of the products on the shop.insidetrading.bg platform, the User shall pay an advance deposit in the amount set by the Supplier. In the event that a product falls within the scope of the previous sentence, the User will be informed of this before placing an order for the product in question, through an informational inscription on the product page on the shop.insidetrading.bg platform.

(3) In the event that the Supplier accepts the return of one item from a set under para. 2, the User has the right to be refunded an amount for the returned item from the set, which is proportional to the ratio between the prices of the items from the set in the Supplier's online store when they are not offered in a set with each other.

VII. SPECIAL CLAUSES APPLYING TO PERSONS WHO HAVE THE CAPACITY OF CONSUMER WITHIN THE MEANING OF THE CONSUMER PROTECTION ACT AND THE ACT ON THE PROVISION OF DIGITAL CONTENT AND DIGITAL SERVICES AND ON THE SALE OF GOODS

Art. 13. The rules of this Section VII of these general terms and conditions apply only to Users for whom, according to the data provided for the conclusion of the purchase and sale contract or upon registration on shop.insidetrading.bg, it can be concluded that they are consumers within the meaning of the Consumer Protection Act, the Electronic Commerce Act, the Act on the provision of digital content and digital services and on the sale of goods and/or Directive 2011/83/EC of the European Parliament and of the Council of 25 October 2011.

Art. 14. (1) The main characteristics of the goods offered by the Supplier on the shop.insidetrading.bg platform are defined in the profile of each product on the shop.insidetrading.bg platform.

(2) The price of the goods, including all taxes and fees, is determined by the Supplier on the shop.insidetrading.bg platform in the profile of each product on the shop.insidetrading.bg platform.

(3) The value of postal or transport costs not included in the price of the goods is determined by the Supplier on the shop.insidetrading.bg platform and is provided as information to the Users when selecting the goods for concluding the purchase and sale contract and before finalizing the order.

If the User does not receive the sent goods more than once, the Supplier reserves the right to:

- charge transport costs to the User for each of his subsequent orders;

- not to provide the right to refuse purchased goods for a period of more than 14 days;

- not to provide gifts with the User's subsequent orders;

- to refuse the "Price Protection", in case the User invokes it.

(4) The methods of payment, delivery and performance of the contract are determined in these general terms and conditions and the information provided to the User through the mechanisms on the shop.insidetrading.bg platform.

(5) The information provided to the Users under this Article is current at the time of its visualization on the shop.insidetrading.bg platform before the conclusion of the purchase and sale contract.

(6) The Users agree that all information required by the Consumer Protection Act and the Act on the Provision of Digital Content and Digital Services and the Sale of Goods may be provided through the interface of the shop.insidetrading.bg platform or by e-mail.

Art. 15. (1) The User agrees that the suppliers on the shop.insidetrading.bg platform have the right to accept advance payment for the contracts concluded with the User for the purchase and sale of goods and their delivery.

(2) The User independently chooses whether to pay the Supplier on the shop.insidetrading.bg platform the price for the delivery of the goods before or at the time of their delivery.

(3) In case the value of the User's order is equal to or exceeds 10,000 BGN, payment shall be made only by transfer or deposit into the Supplier's payment account.

Art. 16. (1) The User has the right, without owing compensation or penalty and without giving a reason, to withdraw from the concluded contract within 30 days from the date of acceptance of the goods by the Supplier through the unified form for withdrawal from the contract, available on the Supplier's website on the shop.insidetrading.bg platform at https://www.shop.insidetrading.bg/terms/ in Appendix No. 1 to these general terms and conditions or through the module set aside on the Supplier's website. Information on exercising the right of withdrawal is available at https://www.shop.insidetrading.bg/terms/ in Appendix No. 2 to these general terms and conditions.

(2) The right of withdrawal under para. 1 shall not apply in the following cases:

1. for the provision of services where the service is provided in full, where the contract provides for an obligation for the consumer to pay, and the performance has begun with the consumer's express prior consent and confirmation that he knows that he will lose his right of withdrawal once the contract has been fully performed by the trader;

2. for the supply of goods or services whose price depends on fluctuations in the financial market that cannot be controlled by the trader and which may occur during the period for exercising the right of withdrawal;

3. for the supply of goods made to order by the consumer or according to his individual requirements;

4. for the supply of goods that, due to their nature, may deteriorate in quality or have a short shelf life, such as food, beverages and nutritional supplements;

5. for the supply of sealed goods that have been unsealed after delivery and cannot be returned for reasons related to hygiene or health protection (such as earplugs, clothing, underwear, swimwear, socks, baby products, epilators, razors, toothbrushes, hairbrushes, medical devices in contact with the human body, including stethoscopes and inhaler masks, etc.);

6. for the supply of goods which, after having been delivered, have become mixed with other goods from which they cannot be separated due to their nature;

7. for the supply of alcoholic beverages, the price of which is agreed upon when the sales contract is concluded, where delivery can be made within a period not earlier than 30 days from the conclusion of the contract, and the actual value of which depends on market fluctuations which cannot be controlled by the trader;

8. where the consumer has expressly requested the trader to visit him at his home for the purpose of carrying out urgent repair or maintenance work; where, during such a visit, the trader provides other services in addition to those requested by the consumer or supplies goods other than the spare parts necessary for carrying out the repair or maintenance, the right of withdrawal shall apply to these additional services or goods;

9. for the supply of sealed sound or video recordings or sealed computer software that are unsealed after delivery, including activation codes for software licenses, software functions or virtual payment instruments. The performance of the contract for the supply of sealed sound or video recordings or sealed computer software (including content codes and digital content not on a tangible medium) that are unsealed after delivery begins from the moment of unsealing and the consumer loses his right of withdrawal, expressly agreeing to this.

10. for the supply of newspapers, periodicals or magazines, with the exception of subscription contracts for the supply of such publications;

11. concluded during a public auction;

12. for the provision of accommodation services that are not for the purpose of living, transport of goods, car rental, catering services or the provision of services related to entertainment activities, if the contract provides for a specific date or period for performance;

13. for the provision of digital content (such as e-books, e-vouchers, electronic video games) that is not provided on a tangible medium, when the performance has begun and the contract obliges the consumer to pay, in cases where: a) the consumer has given his express prior consent to the commencement of performance during the withdrawal period; b) the consumer has confirmed that he is aware that he will thereby lose his right of withdrawal; c) the trader has provided confirmation pursuant to Art. 48, para. 2 or Art. 49, para. 8 of the Consumer Protection Act. By accepting these GTC and placing an order, the consumer expressly gives his prior consent to the commencement of performance and is aware that he will lose his right of withdrawal within the meaning of this point.;

14. perfumes, creams and other bulk cosmetics that have been unsealed after delivery.

(3) When the supplier on the shop.insidetrading.bg platform has not fulfilled its obligations to provide information, as set out in the Consumer Protection Act, the User has the right to withdraw from the concluded contract within a period of one year and 14 days, counting from the date of receipt of the goods. When the information is provided to the user within the withdrawal period, the same begins to run from the date of its provision. The User has the right to send the statement of withdrawal under this article directly to the Supplier through the unified form for withdrawal from the contract, available on the Supplier's website on the shop.insidetrading.bg platform at Annex No. 1 to these general terms and conditions.
